The statutes behind a rider's claim

Vehicle Code § 21202 lets a rider moving slower than traffic leave the right-hand edge to pass, to prepare for a left turn, and to avoid hazards — parked cars, opening doors, and a lane too narrow to share safely. Vehicle Code § 21760, the Three Feet for Safety Act, requires an overtaking driver to leave at least three feet or to slow and pass only when safe.

Vehicle Code § 22517 prohibits opening a car door into traffic when it is not reasonably safe. Along Colorado Blvd and Fair Oaks Ave, where curbside parking runs next to moving lanes, dooring is a recurring cause of serious injury.

What the city's own plan documents

Pasadena's Local Roadway Safety Action Plan reports that the most frequently cited collision factors citywide are unsafe speed (1,185 collisions), automobile right-of-way violations (948) and improper turning (881) — the three behaviors behind most rider injuries.

Right-hook collisions are the recurring pattern at the plan's listed intersections. Vehicle Code § 22100 requires a driver turning right to make the turn from as close to the right-hand curb as practicable, which is the statute those cases are argued under.
