Is the deadline different for malpractice cases?

Yes. California generally requires suit within one year of discovering the injury and no more than three years from the injury itself (CCP §340.5), plus a 90-day notice to the provider. Shorter rules can apply, so do not wait.

How long do I have to file a claim in California?

In most California injury cases you have two years from the date of the injury to file a lawsuit (Code of Civil Procedure §335.1). If a city, county, or state agency is involved, you generally have only six months to file a government claim (Government Code §911.2). Talk to a lawyer early so a deadline never decides your case for you.
