Can my employer fire me for filing a claim?

Retaliating against an employee for filing a workers' compensation claim is illegal in California (Labor Code §132a). Report the injury in writing and keep copies of everything you submit.

How long do I have to file a claim in California?

In most California injury cases you have two years from the date of the injury to file a lawsuit (Code of Civil Procedure §335.1). If a city, county, or state agency is involved, you generally have only six months to file a government claim (Government Code §911.2). Talk to a lawyer early so a deadline never decides your case for you.
