Culver City Wrongful Death Lawyer

A wrongful death case in California is really two cases: the claim the surviving family members hold in their own right, and the claim the person who died held, which passes to the estate. Both are usually brought together, and in Culver City the identity of the investigating agency and any public entity involvement shape the first steps.

Standing and damages

Code of Civil Procedure § 377.60 identifies who may sue: the surviving spouse or domestic partner, the children, and where there is no surviving issue, those entitled to the property by intestate succession, plus certain dependent parents, stepchildren and putative spouses.

Code of Civil Procedure § 377.61 sets what the claim recovers — the financial support the person would have provided, and the loss of their love, companionship, comfort, care and guidance. The survivors' grief is not a separate damages category under California law.

The survival claim

Code of Civil Procedure § 377.30 passes the decedent's own cause of action to the personal representative or successor in interest, and § 377.34 governs what that claim recovers — losses and expenses the person sustained before death, and punitive damages where they would have been available.

Because the categories differ, both claims are pleaded together so nothing available to the family is left unasserted.

Timing

The general deadline is two years from the death under Code of Civil Procedure § 335.1. If a public entity may share responsibility — a city vehicle, a dangerous condition of public property, a roadway design — the six-month written claim requirement in Government Code § 911.2 governs the front end.

Evidence has its own timeline. Vehicles are released and repaired, and camera footage from businesses along Washington, Venice and Sepulveda overwrites within days.

Frequently Asked Questions

What is the difference between a wrongful death claim and a survival claim?

The wrongful death claim belongs to the family members listed in Code of Civil Procedure § 377.60 and covers their own losses under § 377.61. The survival claim is the decedent's own claim, which passes to the estate under § 377.30 and recovers what § 377.34 allows — losses and expenses sustained before death. They are typically filed together.

What clients say

On my way to LAX, a truck driver t-boned my car. I was in the hospital for a few days. Hollywood Law Center came to the hospital and took my information. They made sure my hospital bills were taken care of and got me the compensation I deserved.

What I loved about this firm is that they offer free consultations. They were very honest with me about my personal injury case and advised me of the good and the bad. They didn't just tell me what I wanted to hear — it was refreshing to have someone so honest.
