The three coverage periods

Public Utilities Code § 5433 sets the tiers. When the app is off, only the driver's personal policy applies. When the app is on and the driver is waiting for a match, the statute requires coverage of at least $50,000 per person and $100,000 per incident for death and injury, plus $30,000 for property damage. From acceptance of a ride through the completion of the trip, the statute requires at least $1,000,000 in coverage.

Passengers, other drivers and pedestrians

As a passenger, you are almost never at fault, and your claim may run against the rideshare driver, the other driver, or both. If you were hit by a rideshare driver while walking or in your own car, the same tiers decide the available coverage — you simply have to establish the driver's app status.

Your own uninsured and underinsured motorist coverage can also apply, including in a hit-and-run. We check every policy that might respond before assuming a limit is the ceiling.

First steps in Glendale

I was a passenger. Whose insurance covers me?

If the driver had accepted your ride or the trip was underway, Public Utilities Code § 5433 requires at least $1,000,000 in coverage for that period. If the other driver caused the crash, their policy is also in play. Passengers rarely have any fault issue, so the question is usually which policies respond and in what order.

The driver says the app was off. How is that checked?

Through the trip record held by the rideshare company, requested formally rather than taken on the driver's word. Your own app screenshots, the timestamps on the police report and nearby camera footage corroborate it.

How long do I have to file a claim in California?

Most California injury lawsuits must be filed within two years of the injury (Code of Civil Procedure § 335.1). If a city, county, or state agency is a defendant — a municipal vehicle, a dangerous roadway condition, a public sidewalk — you generally have six months to present a written government claim first (Government Code § 911.2). Talk to a lawyer early so a deadline never decides the case for you.
