Santa Monica, California

Santa Monica Uber and Lyft Accident Lawyer

Which insurance covers an Uber or Lyft crash depends on the driver's app status at the moment of impact. Public Utilities Code § 5433 sets three tiers: app off and only the personal policy applies; app on and waiting for a request, and a contingent policy of at least $50,000 per person, $100,000 per incident and $30,000 property damage applies; en route to or carrying a passenger, and at least $1,000,000 applies. Santa Monica's airport-bound, beach and nightlife trips make this a daily question here.

The Santa Monica pickup problem

Downtown Santa Monica has heavy curb competition: Big Blue Bus stops, protected bike lanes, loading zones and metered parking all occupy the same edge of the roadway. Rideshare drivers stop in a travel lane or across a bike lane because there is nowhere else, and passengers open doors into moving traffic and cyclists. Vehicle Code § 22517 prohibits opening a vehicle door on the traffic side when it is unsafe to do so or leaving it open longer than necessary to load or unload.

Airport and beach runs add freeway exposure. A trip that begins downtown and ends on the I-10 or PCH puts the collision in CHP jurisdiction, which changes where the report comes from and what data exists.

How the claim actually gets handled

Rideshare claims go to third-party administrators, not a local adjuster, and the first question is always app status — because it decides whether a $50,000 contingent policy or a $1,000,000 policy is on the table.

Multiple insurers are usually involved: the rideshare policy, the driver's personal policy and the other motorist's. Each has a reason to wait for the others.

We preserve the trip data and the corridor footage early, deal with the administrator, and keep the two-year limit under Code of Civil Procedure § 335.1 in view — plus the six-month government claim deadline if a public entity or a city vehicle is involved.

How we help

  • We establish app status and the correct coverage tier under Public Utilities Code § 5433
  • We pursue the rideshare policy, the driver and any at-fault third party together
  • We preserve curb, retail and transit camera footage downtown before it is overwritten
  • We deal with the third-party administrator so you are not negotiating alone

Frequently Asked Questions

I was dropped off and hit by a passing car when I opened the door.

That can involve both the driver's choice of where to stop and the door itself. Vehicle Code § 22517 addresses opening a door on the traffic side when it is unsafe, and responsibility may be shared between the rideshare driver, the passing motorist and the passenger under California's comparative fault rules. It is worth having the facts reviewed rather than assuming the answer.

Do I have to use the app's own claims process?

You can report through the app, and you should, but that is not the same as accepting what the insurer offers. You are entitled to independent advice before giving a recorded statement or signing anything.

How long do I have to file a claim in California?

Most California injury lawsuits must be filed within two years of the injury (Code of Civil Procedure § 335.1). If a city, county, or state agency is a defendant — a municipal vehicle, a dangerous roadway condition, a public sidewalk — you generally have six months to present a written government claim first (Government Code § 911.2). Talk to a lawyer early so a deadline never decides the case for you.

What does it cost to hire the firm?

Nothing up front. We work on a contingency fee, so there is no attorney's fee unless we win your case, and the first consultation is free and confidential.

What I loved about this firm is that they offer free consultations. They were very honest with me about my personal injury case and advised me of the good and the bad. They didn't just tell me what I wanted to hear — it was refreshing to have someone so honest.
